Mitchum's "Hardest Working Person" Video Contest
Official Contest Rules

No Purchase or Entry Fee Required. Making a Purchase Will Not Increase Your Odds of Winning.

  1. Timing. The "Hardest Working Person" Video Contest (the "Promotion"), is presented by Revlon Consumer Products Corporation, Mitchum Deodorant brand ("Mitchum", or the "Sponsor"), which begins at 12:01 AM Eastern Time ("ET") on May 17, 2010, and ends at 11:59 PM ET on July 11, 2010 (the "Promotion Entry Period").
  2. Overview. This is a video submission skill contest. Interested parties may participate by uploading a video to YouTube, depicting why their job is tough, and why he or she is the "Hardest Working Person" in America. All entries will be screened for appropriateness, and those deemed eligible/acceptable will be posted on YouTube for general public viewing and voting, and later screened and ranked by representatives of the Sponsor. The "Top 10" entries (the "Finalists") will then have their submissions re-posted on YouTube for a second round of public voting, and prizes will be awarded to those individuals whose submissions score the highest number of points (per judging criteria in paragraph #6, below). Each submission must clearly depict the "Hardest Working Person" theme, in a poignant, relevant manner.
  3. To Enter. Submitters may visit www.mitchumhardestworking.com for complete Contest details, including information on submitting an entry on YouTube.

    Videos entered for judging may include the "Contestant" him/herself (the person featured in the video), or by a friend or colleague (the "Submitter"). Prizes, however, will be awarded to the Contestant only.

    Video entries must be submitted using one of the following formats: AVI (windows); MOV (mac); MPEG; or WMV, must be approximately two minutes in length, and must not exceed a 250 MB file size. Sponsor reserves the right in its sole discretion to accept or reject entries that do not comply with these format, time, and length limitations.

    Each individual video may only be submitted once during the Promotion Period. More than one submission may be made by an individual, but must be entered as a separate contest entry. Entries submitted in violation of the Official Contest Rules will not be considered, including inappropriate or offensive entries, as determined by the Sponsor, in their sole discretion.

    All entries become the property of Sponsor and will not be returned.
  4. Eligibility. Submitter and/or Contestant must be at least 18 years of age at time of entry and a legal US citizen.

    The following are not eligible to participate: a) officers, directors, and employees of the Sponsor, its advertising and promotion agencies, and any other party that is directly involved with the development or implementation of this Promotion; and b) the immediate family members (spouse, parents, children, siblings, and their respective spouses) of employees and household members with whom they may reside (whether related or not). This Promotion is void wherever it may be prohibited and/or restricted by law, and is subject to all applicable federal, state, and local laws.
  5. Voting/Judging/Judging Criteria. There will be three (3) phases of the voting and judging process; (A). the "Preliminary Round" of public voting on YouTube (B.) the "Finalist Round" , conducted by the Sponsor, to determine the "Top 10", and (C.) the "Second Round" of public voting via YouTube.

    The Preliminary Round will take place from May 17, 2010 to July 11, 2010. You may vote for your favorite by checking the "thumbs up" box. Members of the public may vote a maximum of once per video, per day.

    The "Audience Award" will be awarded to the video submission that gets the most thumbs-up during the Preliminary Round (see "Prizes" paragraph, below).

    Properly submitted videos meeting all eligibility requirements will then be judged by the Sponsor, or its independent agent(s), in the Finalist Round, who will determine the "Top 10" entries, which will again be displayed on the Mitchum "Hardest Working Person" YouTube Channel for a second round of public viewing and voting.
    Finalist judging will take place from July 12, 2010 to July 18, 2010, and will be based on the following criteria: a) Relevance to the Promotion Theme (40%), b) Originality and Creativity (40%), and c) Video Quality and Clarity (10%) and public voting preferences from the Preliminary Round (10%). Ties, if applicable, shall be broken using only criterion a). Criterion a) shall be interpreted to mean how well a submitted video entry depicts the "Hardest Working Person" theme.
    The entries with the highest overall scores from the Finalist Round, will then be placed on the Mitchum "Hardest Working Person" YouTube Channel for the Second Round of public voting, which will take place from July 19, 2010 to August 15, 2010.
    The entries with the two highest scores, in the Second Round of public voting, will be awarded the Grand and Second Prizes, respectively.
    Any voting that appears to be conducted using unfair methods, including the use by an individual of multiple email addresses, robotic, or third-party means, will be eliminated, and the voting party disqualified.
  6. Prizes/Odds. There will be three (3) cash prizes awarded. The Grand Prize winner will receive $100,000. The Second Prize winner will receive $20,000. The "Audience Award" winner, from the Preliminary Round of public voting, will receive $5,000, plus a "Golden Stick" of Mitchum Deodorant, valued at $1500.
    Total value of all prizes to be awarded: $126,500.
  7. Prize Awarding. Winners will be selected during the week of August 16 – 23, 2010. The winners will be notified in writing within 7 days of the final winner selection. As part of the prize claim process, each winner must sign and return an Affidavit of Eligibility, a Liability Waiver, and where allowable, a Publicity Release, within 7 days of notification. If a winner does not comply, or if winner notification is returned as undeliverable, the prize will be forfeited and offered to the Entrant who received the next highest score. This process will be repeated until all three winners have been confirmed.
  8. Terms/Conditions. A). By submitting an entry, Submitter warrants and represents that: (i) he/she is the sole and exclusive owner of the copyrights to the video submission, and has obtained a release from all persons appearing in the video, and from all owners of property appearing in the video submitted for consideration; and (ii) the video, or portions thereof, have not been entered in any previous competition or won any previous awards or competitions and is not subject to any lien or encumbrance; and (iii) Submitter has the full and exclusive right, power and authority to submit the video entry, and to grant Sponsor the right to present the submission to the public, without further compensation; and (iv) no rights in the submission have been previously granted to any other person, firm, corporation, or entity.
    B) Sponsor reserves the right to disqualify any submission at any time in the event Sponsor determines, in its sole discretion, that the submission is offensive, inappropriate, not in keeping with Sponsor's image, or that an Entrant has not otherwise complied with these Official Contest Rules.. Further, Sponsor reserves the right to conduct a background check of all Submitters or Contestants whose entry makes it into the "Finalist" round, and to disqualify any Submitter or Contestant that it feels, in its own discretion, would not be a suitable public representative. It shall be the Submitter's responsibility to provide any personal information to Sponsor that it may deem necessary to conduct such background check of Contestant. Any entrant that is deemed to be a minor in his/her state of residence may be required to provide written parental permission before being awarded a prize.
    C) If the submission contains any material or elements that are not owned by the Submitter and/or that are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission of the video, any and all releases and consents necessary to permit the use and exhibition of the submission by Sponsor. This includes, but is not limited to, music and images protected by copyright, trademark, patent, trade secret, right of privacy, right of publicity, and any other third party rights.
    D) By submitting an entry and in consideration of the opportunity to win one of the prizes described herein which Submitter acknowledges is good and valuable consideration, Submitter confirms to the Sponsor their assigned right to make copies of the work of authorship, the right to make derivative works based on the work of authorship by editing, adapting or altering in any way the original submission, the right to distribute and sell copies of the work of authorship, and the right to publicly perform and publicly display the work of authorship in the United States and throughout the world including use on the Internet or in any other manner of Sponsor's choice, without attribution or further compensation. Use of a submission by Sponsor does not suggest in any way that the Submitter is a winner.
    E) By claiming a prize, Submitter agrees that Sponsor and its officers, employees, shareholders, affiliates, agents, and advertising and promotional agencies have no liability whatsoever for any injuries, losses, or damages of any kind related to participation in this Promotion, or from acceptance or use/misuse of any prize offered.
    G) Acceptance of a prize shall constitute Submitter's and Contestant's agreement that Sponsor or its agent(s) may use and/or display their respective name(s), address (city, state only), likeness, biographical information, video entry (and content) and/or prize information, without limitation, for promotional purposes, without further consideration, except where prohibited by law. Further, each winner agrees to participate in a "re-shoot" of the submitted video, in the winner's home town, with all related travel and videotaping expenses to be borne by the Sponsor. Each winner shall participate in the reshoot, without additional compensation. Failure to comply may result in disqualification.
    H) All taxes on prizes (if applicable) are the sole responsibility of the winners.
    I) Prizes are not transferable or assignable, except to a surviving spouse, or at the sole discretion of Sponsor.
    J) Sponsor reserves the right, in its sole discretion to cancel, terminate or suspend this Contest for any reason, including if: (a) viruses, bugs, unauthorized human intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest; or (b) earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance or commotion, terrorism, disruption of the public markets, war or armed conflict (whether or not officially declared). In such event, the prize-winners will be determined by the Sponsor, using the judging criteria above, in Paragraph #5, from all eligible entries received up to the time of such cancellation, termination or suspension.
    K) Disputes: Except where prohibited by law, all disputes concerning this promotion will be governed by and construed in accordance with the laws, rules and regulations of the state of New York without regard to its choice of laws or conflict of laws provisions.
    LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THE WEBSITE ASSOCIATED WITH THIS PROMOTION, OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
  9. Privacy Policy. The use of personal contact information gathered in connection with this promotion will be treated in accordance with the Sponsor's Privacy Policy, which can be found www.revlon.com.
  10. Winner's List. Winner's will be posted online at www.mitchumhardestworking.com, or for a hard copy of the official Winner's List, send a self-addressed, business-size, stamped envelope (after August 9, 2010, but no later than September 10, 2010), to: Mitchum "Hardest Working Person" Video Contest, Winner Confirmation Request, c/o USSC, P.O. Box 25497, Rochester, NY 14625.
  11. Independent Contest Administrator. The US Sweepstakes & Fulfillment Company ("USSC"), 625 Panorama Trail (Bldg. 2, Suite 100), Rochester, NY 14625, an independent agent of the Sponsor who will oversee the fair administration of the Promotion, and the awarding of all prizes. All decisions made by USSC will be considered final and binding.
